Terms of sale

Article 1 – Purpose and Scope
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Siamplantes, a sole proprietor based at 60 rue François 1er, 75008 Paris, France, and any individual or legal entity (hereinafter “Customer”) making a purchase on the website www.siamplantes.com (hereinafter “the Site”).

Any order placed on the Site implies full and unconditional acceptance of these GTC.

Article 2 – Products Offered
Siamplantes offers for sale live plants as well as accessories related to their care. Products are carefully described and photos are provided for illustrative purposes only. In case of error or omission, Siamplantes cannot be held responsible.

Products are available while stocks last. In case of unavailability, the Customer will be informed promptly and may choose a similar product or obtain a refund.

Article 3 – Prices and Payment
Prices are shown in euros (€) including all taxes (TTC) for France and the European Union. For orders shipped to the United States, the United Kingdom, Canada, and other countries, the currency adjusts automatically.

Siamplantes covers customs duties and import taxes for deliveries outside the European Union.

Delivery fees are calculated before order validation and vary depending on the country and delivery method chosen. Payment is made online, securely, at the time of the order.

Article 4 – Order Placement
The Customer selects products, enters necessary information (quantity, delivery address, etc.), verifies the order, and confirms acceptance of these GTC.

The order is validated upon receipt of full payment. Siamplantes reserves the right to refuse or cancel any order in case of dispute or suspicion of fraud.

Article 5 – Delivery
Products are delivered to the address provided by the Customer. The Customer is responsible for the accuracy of the information provided.

Delivery times depend on the carrier and destination country and are indicated at the time of the order. In case of adverse weather conditions or other constraints related to the nature of the plants, Siamplantes may delay shipment to ensure product quality.

The Customer must check the condition of the packages upon receipt and report any damage within 24 hours by email to contact@siamplantes.com with supporting evidence (photos/videos). After this period, no claims will be accepted.

Article 6 – Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to live plants due to their perishable nature.

For other non-perishable products, the Customer has 14 days from receipt to exercise the right of withdrawal and request an exchange or refund, excluding return shipping costs.

Article 7 – Warranty and Liability
Siamplantes guarantees the conformity of sold products in accordance with Articles L217-4 and following of the Consumer Code, as well as the warranty against hidden defects (Articles 1641 and following of the Civil Code).

In case of defective or non-conforming product, the Customer must notify Siamplantes as soon as possible to benefit from a refund.

Siamplantes cannot be held liable for indirect damages related to product use or delivery delays beyond its control.

Article 8 – Intellectual Property
All elements on the Site (texts, images, logos) are the exclusive property of Siamplantes. Any reproduction is prohibited without prior authorization.

Article 9 – Personal Data
Data collected during the order process are used exclusively for order processing and commercial relations. Siamplantes commits not to sell or share this data with third parties.

The Customer has the right to access, modify, and delete their data by contacting Siamplantes at contact@siamplantes.com.

Article 11 – Applicable Law and Disputes
These GTC are governed by French law. In case of dispute, an amicable solution will be sought before any legal proceedings.

Failing agreement, the dispute will be brought before the competent courts in the jurisdiction of Paris.
